Waste Collection Brixton Service Terms and Conditions
These Terms and Conditions set out the basis on which waste collection services are provided within Brixton and surrounding areas. By placing a booking, you agree to be bound by these Terms and Conditions, which form a legally binding agreement between you and the service provider. Please read them carefully before making a booking.
1. Definitions
In these Terms and Conditions, the following definitions apply:
Customer means any individual, business, organisation or other party requesting or receiving waste collection services.
Services means the collection, removal, transportation and disposal or recycling of waste as agreed with the Customer.
Waste means any materials, rubbish, refuse, junk, furniture, appliances, garden materials, construction waste or similar items presented for collection, excluding any prohibited items as set out in these Terms and Conditions or under applicable law.
Site means the address or location where the waste is to be collected.
Agreement means the contract between the Customer and the service provider for the provision of the Services, comprising these Terms and Conditions and any written confirmation provided at the time of booking.
2. Scope of Services
The service provider offers waste collection and related services for domestic and commercial customers in Brixton and selected surrounding areas. Services typically include removal of household waste, bulky items, office waste, garden waste and certain types of construction and renovation debris, subject to these Terms and Conditions and applicable regulations.
The exact scope of the Services, including the type and approximate volume or weight of waste to be collected, will be agreed at the time of booking based on the information you provide. The service provider reserves the right to refuse to collect any items that differ materially from the description provided at booking or that are prohibited by law or by these Terms and Conditions.
3. Booking Process
3.1 You may request a booking by telephone, email or online form where available. The booking will only be confirmed once the service provider has accepted your request and provided a confirmation, which may be verbal, written, or electronic.
3.2 At the time of booking, you must provide accurate and complete information, including:
(a) your full name and contact details;
(b) the Site address and any access information;
(c) a clear and honest description of the waste to be collected, including type, estimated volume or weight and any unusual items;
(d) preferred date and time window for collection;
(e) any relevant parking, loading or access restrictions affecting the Site.
3.3 Any quotation provided before inspection is based on the information supplied by you. Quotations are subject to change if, on arrival, the quantity or nature of the waste differs from your description or if access or parking conditions are not as described.
3.4 The service provider may, at its discretion, attend the Site first to assess the waste before confirming the final price for the Services. You will be informed of any revised price before work begins and you will have the choice to accept or reject the revised price. If you reject it, no collection will take place and no fee will be charged other than any call-out fee that may have been agreed in advance.
4. Access and Customer Responsibilities
4.1 You must ensure that the Site is safe and that there is suitable access for the waste collection team and vehicle at the agreed time. This includes arranging any necessary parking permissions, permits or visitor vouchers and notifying the service provider in advance of any restrictions.
4.2 All waste must be made available at the Site on the agreed date and time, in a condition suitable for safe handling. Waste must not contain prohibited or hazardous materials unless previously agreed in writing and permitted by law.
4.3 The service provider reserves the right to refuse to collect waste where:
(a) access to the Site is unsafe or impractical;
(b) parking is not available or would breach local parking rules;
(c) the waste is contaminated, hazardous, or materially different from what was described at the time of booking.
4.4 If the service provider is unable to carry out the collection due to your failure to provide safe and adequate access, or because the waste is not available as agreed, a wasted journey or cancellation fee may be charged as set out in the cancellations section.
5. Waste Types and Regulations
5.1 All waste collection and disposal activities are carried out in accordance with applicable UK waste management legislation and regulations, including the duty of care requirements for handling, transport and disposal of waste.
5.2 The service provider will take reasonable steps to ensure that collected waste is transported and transferred only to licensed waste transfer stations, recycling centres or disposal facilities, and that appropriate documentation is maintained as required by law.
5.3 The following items are generally considered hazardous or prohibited and will not be collected unless expressly agreed in advance and where legally permitted:
(a) asbestos or materials containing asbestos;
(b) chemicals, solvents, paints, oils or fuels;
(c) medical or clinical waste, sharps, or biological materials;
(d) gas bottles or cylinders;
(e) explosives, firearms or ammunition;
(f) radioactive materials;
(g) any other items that cannot lawfully be collected, transported or disposed of in the course of normal waste collection activities.
5.4 You are responsible for informing the service provider in advance of any items that may be hazardous or require special handling. If hazardous or prohibited waste is found mixed with general waste, the service provider may refuse to collect the entire load or charge additional fees to manage it in compliance with regulations.
6. Pricing and Payments
6.1 Prices are usually based on a combination of factors such as volume, weight, type of waste, loading time, access conditions and any disposal or recycling costs. Any prices stated at the time of booking are indicative estimates unless confirmed as fixed in writing.
6.2 The final price will be confirmed on site before any loading takes place. By allowing the collection team to commence loading, you are deemed to have accepted the price.
6.3 Unless otherwise agreed, payment is due in full immediately upon completion of the Services. Payment may be made by cash, debit or credit card, bank transfer or other methods notified to you at the time of booking.
6.4 For business and account customers, alternative invoicing and payment terms may be agreed in writing. Where credit terms are offered, invoices must be paid within the period stated on the invoice. Late payment may result in interest and recovery costs being charged in accordance with applicable law.
6.5 All prices are stated exclusive of VAT unless expressly stated otherwise. Where applicable, VAT will be added at the prevailing rate.
7. Cancellations, Amendments and Wasted Journeys
7.1 You may cancel or amend your booking by giving reasonable notice prior to the agreed collection time. Where possible, at least 24 hours notice is requested to avoid any charges.
7.2 If you cancel with less than 24 hours notice, or if the collection cannot be carried out for reasons within your control, the service provider may charge a cancellation or wasted journey fee to cover costs incurred, including travel, staff time and any pre-booked disposal charges.
7.3 If you wish to significantly increase or reduce the volume or type of waste to be collected, you must inform the service provider as soon as possible. The provider will confirm whether the amended request can be accommodated and may adjust the price accordingly.
7.4 The service provider reserves the right to cancel or reschedule a booking where necessary due to circumstances beyond its reasonable control, including but not limited to vehicle breakdown, staff illness, severe weather, or road closures. In such cases, the provider will endeavour to give you as much notice as practicable and arrange an alternative collection time. No liability will be accepted for any loss arising from such cancellations or delays.
8. Performance of Services and Timeframes
8.1 The service provider will use reasonable efforts to perform the Services on the agreed date and within the estimated time window. However, any times given are estimates only and are not guaranteed.
8.2 Delays may arise due to traffic conditions, earlier jobs taking longer than anticipated, local access restrictions or other factors beyond the provider's reasonable control. You will be notified of significant delays where possible.
8.3 The service provider will not be liable for any indirect or consequential loss, including loss of earnings or business, arising from any delay in providing the Services.
9. Customer Property and Site Condition
9.1 Reasonable care will be taken when carrying out the Services at the Site. However, you are responsible for protecting any fragile items, flooring, walls or fixtures that could be damaged during the removal of waste. Where practicable, you should move delicate items out of the working area before the collection team arrives.
9.2 The service provider is not responsible for normal wear and tear, minor scuffs, or damage that could not reasonably be avoided in the course of carrying heavy or bulky items, provided reasonable care has been taken.
9.3 You must clearly indicate any items that should not be removed. The collection team will not be liable if unlabeled or unmarked items are taken away in error as part of the waste, unless the removal was clearly unreasonable in the circumstances.
10. Liability and Limitations
10.1 Nothing in these Terms and Conditions limits or excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other matter for which liability cannot lawfully be limited or excluded.
10.2 Subject to the above, the total liability of the service provider for any loss or damage arising out of or in connection with the Agreement, whether in contract, tort, negligence or otherwise, shall be limited to the total amount paid or payable by you for the specific Services giving rise to the claim.
10.3 The service provider will not be liable for any indirect, special or consequential losses, or for any loss of profits, revenue, business, contracts, anticipated savings, or data, whether arising directly or indirectly.
10.4 You agree to indemnify and hold the service provider harmless against any claims, costs, damages or liabilities arising from:
(a) your breach of these Terms and Conditions;
(b) your failure to disclose hazardous or prohibited materials;
(c) any fines, penalties or charges incurred due to incorrect information provided by you about the waste or the Site.
11. Data Protection and Privacy
11.1 In the course of providing the Services, the service provider will collect and process certain personal data such as your name, contact details and address. This information will be used only for the purposes of managing bookings, delivering the Services, handling payments and maintaining records as required by law.
11.2 Personal data will be stored securely and retained only for as long as necessary to fulfil the purposes for which it was collected or as required by law. Appropriate technical and organisational measures will be applied to protect personal data against unauthorised access, loss or misuse.
12. Complaints and Dispute Resolution
12.1 If you are dissatisfied with any aspect of the Services, you should notify the service provider as soon as possible so that the issue can be investigated and, where appropriate, resolved.
12.2 Complaints should normally be raised within a reasonable time of the collection taking place, with any relevant details, including dates, times and supporting information. The service provider will review your complaint and respond within a reasonable timeframe.
12.3 Both parties agree to use reasonable efforts to resolve any disputes amicably in the first instance. If a dispute cannot be resolved by negotiation, either party may seek legal remedies as provided by UK law.
13. Amendments to these Terms and Conditions
13.1 The service provider may amend these Terms and Conditions from time to time to reflect changes in services, legal requirements or operational practices. Any updated version will apply to new bookings from the date it is published or notified.
13.2 The Terms and Conditions in force at the time of your booking will apply to that Agreement, unless changes are required by law or by regulatory authorities, in which case such mandatory changes may apply retrospectively.
14. Severability
14.1 If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, unlawful or unenforceable, that provision shall be treated as deleted, but the remaining provisions shall continue in full force and effect.
15. Assignment
15.1 You may not assign, transfer or subcontract your rights or obligations under the Agreement without the prior written consent of the service provider.
15.2 The service provider may assign or subcontract some or all of its rights and obligations under the Agreement, provided that this does not materially reduce the level of service provided to you.
16. Governing Law and Jurisdiction
16.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or their subject matter or formation, are governed by and construed in accordance with the laws of England and Wales.
16.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter.
By confirming a booking or permitting the collection team to commence work, you acknowledge that you have read, understood and agree to be bound by these Terms and Conditions for waste collection services.
